Elon Musk’s AI company xAI has taken legal action against a user accused of exploiting its technology for illegal purposes. The company filed a federal lawsuit in Texas on July 14, 2026, targeting Terry Harwood of South Carolina.
The lawsuit alleges Harwood uploaded non-sexual images of adults and minors into the Grok chatbot. He then allegedly manipulated the AI to generate sexually explicit deepfakes from those source images, deliberately circumventing the platform's safety guardrails.
Harwood was previously arrested in February 2026 on separate charges of sexually exploiting minors. This civil case runs parallel to those criminal proceedings. xAI is seeking monetary damages and a permanent ban preventing Harwood from using any of its products.
This case is significant as one of the first times an AI company has legally pursued a user for generating child sexual abuse material (CSAM) through its platform. xAI reported suspending over 52,000 accounts in 2026 and filing more than 73,000 reports with the National Center for Missing and Exploited Children.
The issue highlights growing concerns about generative AI. While deepfake CSAM is not new, modern AI systems like Grok can transform ordinary photos into explicit content with minimal technical skill. US law, including the 2024 DEFIANCE Act, provides civil recourse for victims of nonconsensual deepfakes, but most frameworks focus on creators and distributors, not the AI platforms themselves.
