A California jury has unanimously dismissed Elon Musk’s high-profile lawsuit against OpenAI and its CEO Sam Altman. The verdict came after jurors determined Musk had filed his complaint after the statute of limitations had expired.

Musk had alleged that Altman breached a non-profit agreement by transforming OpenAI into a for-profit entity, claiming he was deceived after donating $38 million. The trial, which spanned three weeks, featured testimony from Musk, Altman, and Microsoft CEO Satya Nadella.

During closing arguments, Musk’s attorney asserted it was “not okay to steal a charity.” In response, Altman testified that Musk not only supported the for-profit shift but sought long-term control. Jurors deliberated for roughly two hours before reaching their decision.

OpenAI spokesperson Sam Singer called the verdict a “tremendous victory,” while attorney William Savitt stated that the jury found Musk was not credible. The court also dismissed Musk’s related claims against Microsoft.
