A U.S. judge has dismissed Elon Musk's fraud claims in his lawsuit against OpenAI and its co-founder Sam Altman. The judge, U.S. District Yvonne Gonzalez Rogers, will allow the trial to proceed on Musk's claims of breach of charitable trust and unjust enrichment.
Jury selection begins Monday, with opening arguments scheduled for Tuesday. Musk had requested the dismissal of his fraud claims to simplify the case, focusing on his assertion that OpenAI has strayed from its original mission to benefit humanity, becoming instead a "wealth machine."
The lawsuit alleges that OpenAI, Altman, and Microsoft misled Musk and the public by creating a for-profit entity in 2019 after Musk departed OpenAI's board. OpenAI is reportedly preparing for a $1 trillion initial public offering.
Musk is seeking $150 billion in damages, intended for OpenAI's charitable arm.
