President Donald Trump has nominated James M. McDonald to serve as the next U.S. Attorney for the Southern District of New York. This appointment fills the vacancy left by Jay Clayton, who departed in June 2026 to become Director of National Intelligence.
McDonald brings significant regulatory and legal experience to the role. He previously served as Director of Enforcement at the Commodity Futures Trading Commission from 2017 to 2021. During his tenure, he aggressively pursued cryptocurrency-related fraud, including a major Bitcoin case in the SDNY in 2019.
Before joining the CFTC, McDonald worked as an Assistant U.S. Attorney within the very office he is now nominated to lead. Currently, he is a partner at Sullivan & Cromwell, the prominent law firm that represented the FTX bankruptcy estate. This connection adds complexity to his nomination, given the firm's deep involvement in high-profile digital asset failures.
The shortlist for the position also included Deputy Sean Buckley and Nicolas Roos. The Southern District of New York remains critical ground for major crypto prosecutions, having handled charges related to FTX and Terraform Labs.
