A Quebec judge has authorized a class-action lawsuit against a private Montreal North long-term care home. At least 68 residents died during a COVID-19 outbreak in 2020.
Lead plaintiff Antonio Capobianco alleges the residence's actions contributed to the death of his mother and others, and impacted survivors and their families.
The lawsuit claims the home failed to follow outbreak management protocols, including patient transfers and adhering to infection control procedures for sick staff.
These allegations have not been tested in court. The lawsuit seeks damages for residents, their spouses, caregivers, children, grandchildren, and heirs who were impacted between April and June 2020.
