The federal government is appealing to the Supreme Court after a lower court ruled its use of the Emergencies Act during the 2022 'Freedom Convoy' protests was unjustified and unconstitutional.

The act was invoked to end blockades in Ottawa and at key border crossings, disrupting trade and public order.

In 2024, a federal court found the move violated Charter rights. That decision was upheld by the Federal Court of Appeal in January 2026.

Justice Minister Sean Fraser’s office stated the government must have tools to respond to national security threats but declined further comment due to ongoing legal proceedings.
