Closing arguments are underway in a British Columbia Supreme Court case challenging the right of faith-based hospitals to refuse Medically Assisted Dying (MAID) services. The lawsuit centers on the experience of Sam O'Neill, 34, who endured a painful transfer from St. Paul's Hospital to a hospice to receive MAID in April 2023.
St. Paul's Hospital, a Catholic facility, does not offer MAID. O'Neill's mother, Gayle O'Neill, argued outside court that the transfer subjected her daughter to unnecessary suffering and stripped her of dignity, calling the hospital's actions "cruel."
Daphne Gilbert of Dying with Dignity Canada stated that the court's decision could have significant implications for end-of-life care nationwide.

Plaintiff lawyers contend that patient rights must take precedence in public healthcare when competing rights are at play. Closing arguments are expected to continue throughout the week.
